Terms of Service

These terms govern your use of the PriceMatcher iOS app and the related website at pricematcher.app (together, the “Service”). By using the Service you agree to them. If you don't, please don't use the Service.

1. What the Service does

PriceMatcher helps you track items you bought at Costco against Costco's 30-day price-adjustment window. You upload your own receipts, we extract the items, and we notify you if any of those items appear at a lower price within the window so you can request a refund of the difference at the store.

2. Independence and trademarks

PriceMatcher is an independent product. We are not affiliated with, endorsed by, or sponsored by Costco Wholesale Corporation, and we have no commercial relationship with Costco. “Costco” and the Costco logo are trademarks of Costco Wholesale Corporation, used here only descriptively to identify the retailer the app supports.

3. Your account

You sign in with your Apple ID. You're responsible for keeping that account secure and for everything that happens under it. You must be at least 13 years old (and old enough to enter into a binding contract where you live) to use the Service.

4. Your content

You retain ownership of the receipts and other content you upload. You grant us a limited, worldwide, non-exclusive license to store, process, and display that content solely to operate the Service for you. You represent that you have the right to upload anything you upload and that doing so does not violate any law or third party's rights.

We may suspend or terminate accounts that violate these terms, or that we have a reasonable basis to believe pose a risk to the Service or to other users.

6. Refunds are between you and Costco

PriceMatcher is a tracking and notification tool. We do not file price-match claims on your behalf and we do not guarantee any refund. Whether Costco grants a refund is entirely subject to Costco's policies, the condition and eligibility of the item, and the discretion of the store. We rely on publicly available pricing information and on the contents of the receipts you upload, and that information may be incomplete or out of date.

7. Service availability and changes

We may change, suspend, or discontinue any part of the Service at any time. We'll try to give reasonable notice when changes affect you, but we're not obligated to.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL DETECT EVERY POSSIBLE PRICE DROP.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PRICE MATCH SAVER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

10. Indemnity

You agree to defend and indemnify PriceMatcher against any third-party claim arising out of your misuse of the Service, your content, or your violation of these terms.

11. Governing law

These terms are governed by the laws of the United States and the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.

12. Changes to these terms

We may update these terms from time to time. If a change is material, we'll update the “Last updated” date and notify you in the app before it takes effect. Continued use of the Service after a change constitutes acceptance.
